In Michigan, an injured person is permitted to recover damages due to a product defect if they can prove that (1) the product wasn’t safe and there was an alternative manufacturing process that would not impede the product’s use and (2) the manufacturer was responsible for the defect and said defect was the direct cause of injury.
In addition to these restrictions, Michigan law sets damage caps for product injuries, limiting the amount of compensation an injured person is able to recover.
Drug manufacturers have immunity from product liability laws in Michigan. In the case of an injury sustained resulting from a pharmaceutical drug, an injured person is ineligible to receive compensation for their injuries. As long as the drug was approved by the United States Food and Drug Administration (U.S. FDA), the only exceptions to the immunity rule for pharmaceutical manufacturers are if (1) they were intentionally withholding or misrepresenting information to the FDA or (2) making illegal payments to the FDA.
