Commemorating the Third Anniversary of Andary: A Landmark Victory for Thousands of Michigan Auto Crash Survivors
For 75 years, Sinas Dramis Law Firm has proudly served as Michigan’s Advocates for the Injured, standing beside individuals and families during some of the most difficult moments of their lives.
That mission was powerfully demonstrated through the firm’s advocacy in one of the most significant legal victories for injury victims in Michigan history: the Michigan Supreme Court’s landmark decision in Andary v. USAA Casualty Insurance Company.
A Landmark Decision That Changed Michigan No-Fault Law
In its decision, issued on July 31, 2023, the state’s highest court ruled that the cost-saving provisions enacted as part of Michigan’s 2019 no-fault reforms could not be applied retroactively to individuals injured before the law took effect. The Court held that insurers must continue to provide the lifetime benefits promised under the insurance policies that were in effect when those individuals were injured.
The decision preserved access to benefits that thousands of crash survivors and their families feared they had permanently lost, including essential medical treatment, rehabilitation services, attendant care, and support necessary to live independently.
“Three years later, the Andary victory still belongs to every survivor and family who refused to give up when their care and future were threatened,” said George T. Sinas added that the case represents one of the most meaningful accomplishments in the firm’s history.
